Senior partner Sheri Holland won a defense verdict in Kings County (Brooklyn) Supreme Court on June 27. Plaintiff was a passenger on a chartered bus bound for Pennsylvania. While proceeding north in Manhattan, the bus came to a sudden stop as plaintiff was walking up the aisle, causing her to fall forward. She subsequently underwent a cervical fusion surgery. The bus driver maintained that he was cut off by a taxi, while three other passengers in the bus - all of whom knew or were related to the plaintiff - testified that the bus was speeding before the accident. Ms. Holland's skilled cross-examination of the passengers showed their alliance with plaintiff and compromised their credibility. The jury deliberated just over 3 hours before returning a verdict of no liability. Plaintiff's settlement demand was $2.3 million, and she declined a settlement offer of $400,000 during the trial.
